Does it really matter? Yes, he should be locked away or executed. But that has nothing to do with his guilt or innocence.
Society needs something to hate and fear. The reason Germany got back on its feet and had another go at world domination was that Hitler gave it something to unite behind. The hatred and fear of people such as the Jews. If he had held back, not gone for the rest of Poland, and instead of building death-camps had kept persecution down to acceptable levels of the odd lynchings and so on (which most socieies work just fine with) Germany would still be a world power.
Or look at the Cold War. If socialistic governments were allowed to work then the lower classes would have been better off. But there are much more important things to worry about than them. Do you really think the Americans would have been able to send men to the moon if there wasn't the fear that the hated Communistskis would do it first? Likely, would the USSR have spent all the resources to get the first satelite into orbit, first probe to the moon, first pictures of the moon, first orbit around the moon et cetera if not to beat the Americans?
An enemy, someone to hate and fear is a very valuable thing. Today it's Muslims and the Middle East. It might cost us people like Hicks, but if used correctly, will be well worth it.
